Voraussetzungen / Organisatorisches
The lecture is directed to law students, particularly those participating in the Schwerpunktbereich 6: Völker- und Europarecht, and requires a basic knowledge of public international law. The course is open to students participating in level 4 of the Law Faculty’s Fachspezifische Fremdsprachenausbildung (FFA). They will be given the opportunity either to obtain a certificate of regular attendance or a graded certificate, thus enabling them to fulfil the requirements for the FFA certificate. The lecture is also open to students enrolled in the master programme Internationale Politik und Internationales Recht.
The colloquy will be held in English. All students will have the opportunity to give an oral introductory presentation (approximately ten minutes) on one of the cases and to submit a short written case study in order to obtain a graded certificate. If enough participants volunteer, two cases will be discussed during each session. Otherwise, only a selection of the cases below can be addressed. All participants are expected to read indicated parts of the cases in preparation for the colloquy to meet the objective of actively discussing the court’s decision.

Inhalt
Content: The colloquy offers the opportunity to read, discuss and analyse some of the international cases that have had a lasting impact on the development of international law in a seminar-like atmosphere. In contrast to a lecture series, the main focus of the colloquy is to engage into a discourse with all participants on the relevant legal questions. With a short student presentation on each case as the starting point, the main legal problems and the solutions provided by the Court or Tribunal shall be discussed in the plenary to shed light on the case’s impact upon the understanding and further development of the law. If possible, one session will involve two presentations in order to contrast the decisions. By putting such ‘milestones’ in international jurisprudence into context, the participants deepen their understanding of substantive public international law but likewise of procedural law in dispute settlement. As the working language of the colloquy is English, the class serves to improve the participants’ language and discussions skills that are indispensable (not only) for internationally oriented lawyers.

All cases are available online at the websites of the ruling Court or Tribunal. Comprehensive summaries of the judgments are available online as well.

This course offers a first overview of the law of the European Union, which, besides covering institutional and normative basics, aims to convey a deeper understanding of certain methodological and topical issues. It therefore primarily may be of interest to those students who have no prior knowledge of European Union law.

Inhalt
The first part of the course covers the basics of European Law. It will necessarily be incomplete; by focusing on structural and methodological elements, however, students will receive the tools to deal broadly with issues not discussed in substance. Topics covered include: the Union’s institutions, the different proceedings before the European Court of Justice, the relationship between European Union law and national law, and the internal market and its four fundamental freedoms. Building thereupon, the second part of the course will highlight certain issues usually not discussed in depth. Focal points include for instance external relations and the Union’s relationship to international law (e.g. the Court of Justice’s relationship to international courts or even recent developments in the jurisprudence of the European Court of Human Rights); and the multiplication of instruments for human rights protection in the European Union (general principles, the Charter on Fundamental Rights, the European Convention on Human Rights).

Empfohlene Literatur
Bringing the relevant norm texts (in particular the Union’s constituent treaties) to class in English is absolutely required. I recommend buying or borrowing Blackstone’s EU Treaties & Legislation 2017-2018 (ed. Nigel Foster). Pdfs of the treaties are also available online and may be used in class, though not in case of examination.
